IMPORTANT NOTICE: Brodie is a technology platform only. We are not a seller, retailer, or agent. We are
not responsible for the quality, condition, hygiene, safety, legality, or authenticity of any item listed on the
Platform. All transactions are entered into solely between buyers and sellers. By using Brodie, you
acknowledge and accept this in full.

These Terms and Conditions govern your use of the Brodie website and platform. By accessing or using Brodie, you
agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1.1 Who we are

Brodie is a peer-to-peer online marketplace that connects independent buyers and sellers of pre-loved wigs. Brodie
provides technology infrastructure only. We do not manufacture, inspect, authenticate, store, handle, or ship any
items listed on the Platform. We are not a party to any contract formed between a buyer and a seller and have no
control over and make no representations regarding the quality, safety, legality, or accuracy of any listing.

1.2 No endorsement of listings

The appearance of any listing on the Platform does not constitute an endorsement, recommendation, or warranty
by Brodie in respect of that item or its seller. Brodie does not verify the accuracy of any listing and accepts no
responsibility for any inaccuracies, misrepresentations, or omissions made by sellers.

1.3 Eligibility

To use Brodie you must be at least 18 years of age, a resident of the United Kingdom or an eligible territory, and have
the legal capacity to enter a binding contract.

1.4 Account registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs
under your account. Brodie accepts no liability for loss or damage arising from your failure to comply with this
obligation.

1.5 Platform role — marketplace only

Brodie acts solely as an intermediary technology platform facilitating introductions between buyers and sellers. Brodie
expressly excludes all liability in respect of:

● The condition, quality, hygiene, cleanliness, or safety of any item listed or sold
● The accuracy or completeness of any listing
● The conduct, acts, or omissions of any buyer or seller
● Any dispute arising between a buyer and a seller
● Any loss, damage, injury, or adverse reaction arising from items purchased through the Platform
● The authenticity of any item claimed to be a specific brand
● Any item lost, delayed, or damaged in transit
● The solvency, reliability, or trustworthiness of any user

1.6 No warranty

The Platform is provided on an 'as is' and 'as available' basis without any warranty of any kind, express or implied.
Brodie makes no representations or warranties regarding the availability, accuracy, reliability, or completeness of the
Platform. To the fullest extent permitted by law, Brodie disclaims all warranties including but not limited to implied
warranties of merchantability, fitness for a particular purpose, and non-infringement.

1.7 Limitation of liability

To the fullest extent permitted by applicable law:

● Brodie shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages
of any kind
● Brodie shall not be liable for any loss of profits, revenue, data, goodwill, or business opportunity
● Brodie shall not be liable for any damage to or loss of property arising from items bought or sold on the
Platform
● Brodie shall not be liable for any physical injury, allergic reaction, health issue, or hygiene-related harm arising
from items purchased through the Platform
● Brodie's total aggregate liability to any user shall not exceed the lower of: (a) the value of the transaction to
which the claim relates, or (b) £100

Nothing in these Terms excludes or limits Brodie's liability for death or personal injury caused by our negligence,
fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

1.8 Indemnification

You agree to indemnify, defend, and hold harmless Brodie, its officers, directors, employees, and agents from and
against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising
from or relating to: (a) your use of the Platform; (b) any listing you create; (c) any transaction you enter into; (d) your
breach of these Terms; or (e) your violation of any applicable law or the rights of any third party.

1.9 Third party services

Brodie uses third-party services including payment processors, shipping providers, and analytics services. Brodie
accepts no liability for the acts, omissions, or failures of any third-party service provider. Your use of third-party
services is subject to their own terms and conditions.

1.10 Fees and payments

Listing on Brodie is always free for sellers. Brodie charges buyers a service fee of 8% of the item price at checkout,
with a minimum fee of £2.50. This fee is added on top of the item price and paid by the buyer at the point of
purchase. Sellers receive the full listing price with no deductions. Buyers are also responsible for paying shipping
costs at checkout. All fees are subject to change with reasonable notice.

1.11 Prohibited conduct

Users must not: list prohibited items; use the Platform for fraud or illegal purposes; harass other users; transact off-
platform to avoid fees; create multiple accounts; or use automated tools to access the Platform without consent.
Violations may result in suspension or permanent removal.

1.12 Termination

Brodie reserves the right to suspend or terminate any account, remove any listing, or restrict access to the Platform
at any time and for any reason, including breach of these Terms, without notice and without liability to you.

1.13 Changes to Terms

Brodie reserves the right to update these Terms at any time. Continued use of the Platform after notification of
changes constitutes acceptance.

1.14 Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive
jurisdiction of the courts of England and Wales.

  1. Privacy Policy

This Privacy Policy explains how Brodie collects, uses, stores, and protects your personal data. We comply with the
UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

2.1 Data controller

2.2 What data we collect

Account data
● Name, email, username, profile photo, date of birth, billing and delivery address

Transaction data
● Purchase and sales history, payment information (processed by our provider — we do not store card details),
shipping information

Usage data
● IP address, device information, pages viewed, search queries, browsing behaviour

Verification data
● Identity documents for seller verification where required, bank details for payouts processed by our payment
provider

2.3 How we use your data

● To create and manage your account and facilitate transactions
● To process payments and payouts
● To provide buyer protection and handle disputes
● To send transactional communications and, where consented, marketing
● To detect fraud and enforce our policies
● To comply with legal obligations

2.4 Data sharing

We share data with payment processors, shipping providers, and law enforcement where required by law. We do
not sell your personal data.

2.5 Your rights

Under UK GDPR you have the right to access, rectify, erase, restrict, and port your data, and to object to processing.

2.6 Retention

Account data is retained for the duration of your account and 6 years after closure. Transaction records are kept for
7 years.
